Please read these Terms of Use (“Terms”) carefully before using Argus Capture by Agata Hexe operated by Agata Hexe Studio.

By downloading, installing, or using Argus Capture by Agata Hexe, you agree to be bound by these Terms.

License

Agata Hexe Studio grants you a limited, non-exclusive, non-transferable, perpetual license to use Argus Capture by Agata Hexe.

Each license is valid for one Mac at a time, bound to your hardware identifier. You may transfer your license to a different Mac at any time using the Activate License Key flow. To transfer your license, contact [email protected].

Payments

Payments are processed by Paddle.com Market Ltd as our Merchant of Record. Paddle handles all payment processing, invoicing, sales tax, and VAT on our behalf. By purchasing Argus Capture by Agata Hexe, you also agree to Paddle’s Terms of Use and Privacy Policy.

Screen Recording & Content Responsibility

Argus Capture provides tools to capture screenshots and record your screen. You are solely responsible for the content you capture and how you use it. You agree not to use Argus Capture to:

  • Record or capture content you do not have the right to capture
  • Violate any applicable privacy, wiretapping, or recording consent laws
  • Infringe on the intellectual property rights of others

Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble Argus Capture by Agata Hexe
  • Use Argus Capture by Agata Hexe for any unlawful purpose
  • Distribute, sublicense, or sell copies of Argus Capture by Agata Hexe
  • Remove or alter any proprietary notices
  • Use Argus Capture by Agata Hexe to infringe on the rights of others

Intellectual Property

All content, features, and functionality of Argus Capture by Agata Hexe are owned by Agata Hexe Studio and are protected by international copyright, trademark, and other intellectual property laws.

Limitation of Liability

To the maximum extent permitted by applicable law, Agata Hexe Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Argus Capture by Agata Hexe.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or © any matter for which liability cannot be excluded or limited under applicable law.

EU consumers: You have statutory warranty rights under the EU Digital Content Directive (2019/770) and the Consumer Rights Directive (2011/83/EU). These Terms do not affect your statutory rights under applicable consumer protection law.

Refund Policy

Purchases are processed by Paddle.com as our Merchant of Record. Argus Capture offers a 7-day free trial with full functionality — no payment required. If you purchase a license and are unsatisfied, you may request a refund within 14 days of purchase in accordance with EU consumer protection law. Contact [email protected] or use Paddle’s self-service refund process.

Age Requirement

You must be at least 13 years old to use Argus Capture by Agata Hexe.

Termination

We may terminate or suspend your access to Argus Capture by Agata Hexe immediately, without notice, for conduct that we believe violates these Terms or is harmful to other users or Agata Hexe Studio.

Governing Law

These Terms shall be governed by the laws of the Republic of Austria, European Union. If you are a consumer in the EU/EEA, you also benefit from the mandatory consumer protection provisions of the laws of your country of residence.

Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board, but we are committed to resolving disputes directly with our customers.

Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the “Last updated” date.
